1. Acceptance of Terms

By accessing or using the Hisbuu platform ("Service"), operated by Dhofar Digital ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree, you may not use the Service.

2. Description of Service

Hisbuu is a driver operations and financial management platform designed for delivery and logistics companies. The Service includes driver onboarding (KYC), daily submission tracking, data reconciliation, payout management, asset tracking, and related administrative tools. The Service is provided as a Software-as-a-Service (SaaS) or as a self-hosted deployment depending on your subscription plan.

3. Account Registration

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You must promptly notify us of any unauthorized access to your account.
Each user account is for a single individual and may not be shared.
Admin accounts are responsible for managing driver accounts and permissions within their organization.

4. Acceptable Use

You agree to use the Service only for its intended purpose — managing driver operations and related financial workflows. You may not:

Use the Service for any unlawful purpose or in violation of any applicable regulations.
Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems.
Upload malicious code, viruses, or any content intended to disrupt the Service.
Reverse engineer, decompile, or attempt to extract the source code of the platform.
Resell, sublicense, or redistribute access to the Service without written authorization.
Use the Service to store or process data unrelated to driver operations management.

5. Data Ownership

You retain full ownership of all data you upload to or generate through the Service, including driver records, submissions, financial data, and uploaded documents. We do not claim any ownership rights over your content. We access your data only as necessary to provide and maintain the Service as described in our Privacy Policy.

6. Subscription & Payment

Pricing is based on the number of active drivers and the selected plan tier, as published on our pricing page.
Subscriptions are billed monthly or annually as agreed upon during onboarding.
All fees are quoted and payable in Omani Rial (OMR) unless otherwise specified.
We reserve the right to adjust pricing with 60 days' written notice. Existing contracts will be honored until renewal.
Late payments may result in temporary service suspension after a 15-day grace period with written notice.

7. Service Availability

We strive to maintain 99.9% platform uptime. However, we do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated at least 48 hours in advance. We are not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.

8. Termination

You may terminate your subscription at any time by providing 30 days' written notice.
Upon termination, you may request an export of your data within 30 days. Our standard retention period for company-managed account and operational records is the subscription period plus 12 months after it ends. Records are then deleted or anonymized, subject to valid earlier deletion requests and any legal obligation or unresolved legal claim requiring specific records to be retained. See our Privacy Policy for retention and deletion details. Companies operating their own deployments are responsible for applying these processes to their systems.
We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees after the grace period, or engage in activity that threatens platform security.
Termination does not relieve you of any outstanding payment obligations.

9. Limitation of Liability

To the maximum extent permitted by law, Hisbuu and Dhofar Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Intellectual Property

The Hisbuu platform, including its design, code, features, documentation, and branding, is the intellectual property of Dhofar Digital. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. White-label deployments grant branding customization rights but do not transfer ownership of the underlying platform.

11. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email to active account holders at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These Terms are governed by the laws of the Sultanate of Oman. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Muscat, Oman.
